D. When you are a registered user of the Moonboon app:

- To improve the user experience and the services provided to you in the Moonboon app.
- Legal Basis:

- When we process personal data in the improvement of current and the development of new products and features, it is based on our legitimate interest (Article 6(1)(f) of the GDPR).
E. When you use the Intelligent Baby Monitor:
- What we collect:
- Live video and audio stream from the monitor.
- Video and audio streams only happen live. We don’t record or store video or audio streams without your prior consent.
- Why we collect it (Purpose):
- To enable you to stream video and audio from your monitor to your smartphone.
- Legal Basis:
- The processing is necessary for the performance of a contract with you (Article 6(1)(b) of the GDPR), as we can’t provide the service without processing your data.
F. When you consent to using the intelligent features of the baby monitor:
- What we collect:
- Audio recordings.
- Why we collect it (Purpose):
- To improve the quality of the intelligent features for you and other users by periodically retraining our machine learning model.
- To gather feedback on the accuracy of notifications that you receive.
- Legal Basis:
- We only use your audio recordings for the above purpose, if you have given us your prior explicit consent (Article 6(1)(a) of the GDPR).
- To the furthest extent possible, we aim to use only anonymized data in our development and training of machine learning.

We do not sell your personal data.
However, to run our business and provide our services, we share your data with trusted partners who process data on our behalf (these are called “data processors"). We only share what is necessary, and we have contracts (data processing agreements) in place with these partners to ensure they protect your data and that they only process the data, as instructed by us.
These partners fall into the following categories:
- Service providers and processors: To host our website and maintain our IT systems.
- Payment and financial service providers: To process payments, subscriptions, and refunds.
- Logistics, fulfillment, and warehouse partners: To provide processing logistics for physical goods like shipping and returns.

5. Transfer of Data to Countries Outside the EU/EEA
Some of our service providers may be located outside the European Union/European Economic Area (EU/EEA). When we transfer your data to such countries, we ensure that your data is still protected to a standard equivalent to that within the EU.

6. How Long Do We Keep Your Data? (Retention Period)
We only store your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required by law.
Product purchase: Data collected in relation to purchases on Moonboon.com cf. point 2 B will be deleted as a starting point and after 3 years. However, the data may be stored longer if Moonboon has a legitimate need for longer retention.
Newsletter Consent: We keep your data for as long as you are subscribed to our newsletter. If you unsubscribe, we will delete your information as soon as possible, unless we have another legal basis to keep it.
Moonboon mobile app account: We keep your data for as long as you have an active account. If you decide to delete your account, your personal data will be deleted or anonymized after 30 days of account deletion.
Machine learning features consent: We keep the anonymized data collected from your usage of our machine learning features for as long as you have an active Moonboon mobile app account.
Customer Service Inquiries: We generally delete these after 2 years, unless there is a specific reason to keep them longer (e.g., an ongoing dispute).
7. Your Data Protection Rights
Under the GDPR, you have several rights regarding your personal data, which include:
- The Right to Access: You have the right to request a copy of the personal data we hold about you.
- The Right to Rectification: You have the right to ask us to correct any inaccurate or incomplete personal data.
- The Right to Erasure ("The Right to be Forgotten"): You have the right to ask us to delete your personal data when it is no longer necessary for the purposes it was collected for, or if you withdraw your consent.
- The Right to Restrict Processing: You have the right to request that we limit the processing of your data in certain circumstances.
- The Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transfer it to another controller.
- The Right to Object: You have the right to object to our processing of your data when it is based on our legitimate interests. You also have an absolute right to object to your data being used for direct marketing.
